Pleasehelpusimproveoursite! × Nothankyou LII U.S.Code Title38 PARTI CHAPTER1 § 105 38U.S.Code§105-Lineofdutyandmisconduct U.S.Code Notes prev|next (a) Aninjuryordiseaseincurredduringactivemilitary,naval,air,orspaceservicewillbedeemedtohavebeenincurredinlineofdutyandnottheresultoftheveteran’sownmisconductwhenthepersononwhoseaccountbenefitsareclaimedwas,atthetimetheinjurywassufferedordiseasecontracted,inactivemilitary,naval,air,orspaceservice,whetheronactivedutyoronauthorizedleave,unlesssuchinjuryordiseasewasaresultoftheperson’sownwillfulmisconductorabuseofalcoholordrugs.Venerealdiseaseshallnotbepresumedtobeduetowillfulmisconductifthepersoninservicecomplieswiththeregulationsoftheappropriateservicedepartmentrequiringthepersontoreportandreceivetreatmentforsuchdisease. (b) Therequirementforlineofdutywillnotbemetifitappearsthatatthetimetheinjurywassufferedordiseasecontractedthepersononwhoseaccountbenefitsareclaimed(1)wasavoidingdutybydesertingtheserviceorbyabsentinghimselforherselfwithoutleavemateriallyinterferingwiththeperformanceofmilitaryduties;(2)wasconfinedundersentenceofcourt-martialinvolvinganunremitteddishonorabledischarge;or(3)wasconfinedundersentenceofacivilcourtforafelony(asdeterminedunderthelawsofthejurisdictionwherethepersonwasconvictedbysuchcourt). (c) Forthepurposesofanyprovisionrelatingtotheextensionofadelimitingperiodunderanyeducation-benefitorrehabilitationprogramadministeredbytheSecretary,thedisablingeffectsofchronicalcoholismshallnotbeconsideredtobetheresultofwillfulmisconduct.
