Article4ThemattersdesignatedinthisActastheresponsibilityofthecompetentauthorityofthemunicipalityorcounty(city)areasfollows:1.Planningandimplementationofwaterpollutioncontrolplansunderjurisdiction;2.ImplementationoftheWaterPollutionControlAct,andestablishment(determination),approval,interpretationandimplementationofpollutioncontrollawsandregulationsunderjurisdiction;3.Planning,managementandimplementationfortheuseofthewaterpollutionpreventionfeesreferredtoinArticle11(1)oftheAct;4.Researchanddevelopmentofwaterpollutioncontrolunderjurisdiction;5.Trainingandmanagementofwaterpollutioncontrolpersonnelunderjurisdiction;6.Monitoringandtestingofwaterpollutioncontrolunderjurisdiction;7.Waterpollutioncontrolsurveyworkandcompilationofstatisticsunderjurisdiction;8.Waterpollutioncontrolpublicawarenessworkunderjurisdiction;9.Otherwaterpollutioncontrolmattersunderjurisdiction. Article4-1ThemattersgovernedbylocalgovernmentsinaccordancewithArticles11(2),(7)and(9)and44(2)and(3)oftheActareasfollows:1.Establishment(determination),approval,interpretationandimplementationoflocalautonomyrulesforthewaterpollutioncontrolfeesreferredtoinArticle11(2)oftheAct(hereinafterreferredto“householdwaterpollutioncontrolfees”);2.Impositionandreviewofhouseholdwaterpollutionprotectionfees,checkoftargetsfromwhichthefeesarecollected,planningofuse,management,implementation,demandforfeepaymentandpenalty;and3.Othermattersrelevanttohouseholdwaterpollutioncontrolfees. Article4-2Theterm“household”asreferredinArticle11(2)andItem7ofSubparagraph2of(3)andArticle44(2)oftheActreferstothosethatdischargesewageratherthanthetargetsfromwhichthefeesarecollectedinaccordancewithArticle11(1). Article5AsreferredtoinArticle5ofthisAct,"thecarryingcapacityofawaterbodymaynotbeexceededwhenawaterbodyisutilizedtoreceiveorconveffluent"meansthatanychangesinthewaterqualityofawaterbodythatarecausedbythetotalquantityofdischargesfromallpollutionsourcesthatusesaidwaterbodytoreceiveorconveyeffluentmaynotexceedthewaterclassificationsandwaterqualitystandardsdeterminedpursuanttoArticle6ofthisAct. Article6"Buildingsewagetreatmentfacilities"referredtoinpar1ofArticle7,Article8,Article25,par1ofArticle26,Article62,par2andpar3ofArticle69ofthisActmeansfacilitiesfortreatinghumanexcrementandotherdomesticsewageproducedbyhumanactivitieswithinabuilding. Article7ThefollowingitemsshallbecheckedwhenanengineerperformssignatureworkpursuanttoArticle17(4)ofthisAct.1.Designofthewastewater(sewage)andsludgetreatmentsystem:(1)Reliabilityandreasonablenessofwastewaterandsewagewaterqualityandwatervolumesurveyinestimates;(2)Whetherthewastewaterandsewagetreatmentdesignrequiresasmall-scaleexperimentandwhethernecessaryreliabledesignparametershavebeenachieved;(3)Whetherthefunctionsandcalculationsdesignedforthewastewater(sewage)andsludgetreatmentsystemareadequatefornecessaryfunctionsandequipment,andwhetherthedesignofotherfacilitieslegallyrequiredcomplieswithapplicableprovisionsoftheAct;and(4)Otheritemsthecompetentauthorityhasdesignatedasrequiringchecks.2.On-sitechecksandfunctionalitytestingperformedbytheproprietor:(1)Thespecificationsofwastewater(sewage)orsludgetreatmentfacilitiesshallbecheckedwhentheconstructionofthesefacilitiesiscompletedtodeterminewhethertheyareconsistentwiththeoriginaldesigndiagrams.Whetheranyinconsistencieshavebeennotedandexplainedintheplanmodificationstatementshallalsobechecked.(2)Whenfunctionalitytestingisbeingperformedfollowingthecompletionofthetrialoperationofwastesewageorsludgetreatmentfacilities,theengineershallconductanon-sitechecktodeterminewhethertheenterprise'swastewater(sewage)andsludgeoutputvolume,operationalconditionsformanufacturingprocess,operationalstatusandoperatingparametersofwastewater(sewage)andsludgetreatment,samplinglocations,samplequantityandsamplingfrequencycomplyregulations,andwhetherrelevantrecordsarereliable.(3)Whethertheresultofwaterqualitytestingindictedinthefunctionalitytestingreportcomplieswiththefunctionsdesignedforthewaste(sewage)treatmentsystem,andwhetherthecontentofthefunctionalitytestingreportisconsistentwiththeresultsobtainedandrecordsmadefromfunctionalitytesting,andcomplieswithregulations.(4)Whetherapplied(andreporting)documentsareconsistentwithon-sitechecks;(5)Whethertheenterprise'sstandardoperatingproceduresandemergencyresponsemeasureswithregardtooperation,maintenanceandserviceofwastewater(sewage)andsludgetreatmentfacilitiesaresufficienttoensuremaintenanceofnecessaryfunctionsandtheemergencyresponseability.(6)Otheritemsthecompetentauthorityhasdesignatedasrequiringchecks. Article8Thestreamliningdischargeasdefinedunderpar1,Article18-1oftheactreferstooneofthefollowingcircumstances:I.Usingdedicatedpipework,trenches,gateadjustmentorpumpdrawingmethodtoroutethewastewater(pollutedwater)tobedischargedviatheunapproved,unregistereddischargepoint,ordischargingwastewater(pollutedwater)intothewastewatertrenchesnotapprovedbycompetenttrenchmanagementauthorities,exceptwhereitonlydischargesbutmakingnocontactofthecoolingwater.II.Unapprovedandunregisteredgatheringofwastewater(pollutedwater),processingcomponent,process,butdischargedthroughtheapproved,registereddischargepointencompassesthefollowingcircumstances:(I)Thedischargedwastewater’s(pollutedwater)pollutantconcentrationisatfivetimesormoreofthethresholdofthedischargestandards,exceptthehydrogenionconcentrationindex,e-colibacterialcolonyandwatertemperatures.(II)Thedischargedwastewater’s(pollutedwater)solublehydrogenionconcentrationindexissmallerthantwoorgreaterthaneleven.III.Dischargingthewastewater(pollutedwater)viathesamplingpointwhenasamplingpointisinstalledatajointdischargepipework’swastewater(pollutedwater)trenchsystem.IV.Dischargingwastewater(pollutedwater)viaabusinessorwastewatertrenchsystemwithretentionpermitobtained,wherethedischargedwaterqualitymeetsoneofthecircumstancesdescribedundersubparone,subpartwoorpartwo.V.Inothercircumstanceswherethecompetentgovernmentauthoritiesreckonitcircumventingtheapproved,registeredgathering,processingcomponent,process,ordischargingthroughunapproved,unregistereddischargepoint,inanattempttocircumventthecompetentgovernmentauthoritiestoconductscreening,testingandrelatedaudit. Article9Thewastewater(pollutedwater)(pre-)processingfacilityasdefinedunderpar4ofArticle18-1oftheactshallcomewithsufficientfunctionsandequipment,whicharestipulatedasfollows:I.Underthemaximumproductivity,servicescale,theforeseeableanomalyoperationorsuddensurgeofwatervolumecapacityandthemandatedgatheringofrunoffwastewatershallbeabletoensurethattheprocessedwastewater(pollutedwater)complywiththeactanditsrelevantstipulations.II.Thefacility’sdamageproneanddifficulttoreplacepartsshallcomewiththebackupdevice;partspronetodamageshallcomewithsparepartsoninventory.III.Adedicatedvoltmeterhasbeeninstalled;ofcircumstancesasstipulatedunderArticle56ofthewaterpollutionpreventionmeasuresandscreening/testingdeclarationmanagementmeasuresshallhaveadedicatedelectronicvoltmeterinstalled.Theprecedingparagraphparonehasstipulatedoftheforeseeableanomalyoperationorsuddensurgeofwatervolumecapacityandmandatedrunoffwastewatertobegathered,ofthosewithawastewater(pollutedwater)dailyoutputvolumereachingfivehundredcubicmetersormore,theprocessingcapacitymaynotfallbelowafivepercentofthewastewater(pollutedwater)(pre-)processingfacility’smaximumcapacity;ofthosewithawastewater(pollutedwater)dailyoutputvolumenotreachingfivehundredcubicmeters,theprocessingcapacitymaynotfallbelowatenpercentofthewastewater(pollutedwater)(pre-)processingfacility’smaximumcapacity. Article10Thewastewater(pollutedwater)(pre-)processingfacilityasdefinedunderpar4,Article18oftheactshallbemaintainedinnormaloperation,whichisstipulatedasfollows:I.Itisexecutedwithinthescopeofoperatingparametersperthewaterpollutionpreventionmeasureplan’sapproveddocuments,thewastewater(pollutedwater)dischargegroundwaterbodypermit,themakeshiftdischargepermitdocument,thewastewater(pollutedwater)retentionpermitdocument,thewastewater(pollutedwater)dilutionpermitdocumentandthewastewater(pollutedwater)dischargesoiltreatmentpermitcertificationandrelatedregistrations.II.Theheightoftheaccumulatedsludgeatthecenterdistancebetweenthecondensationfacility’sinflowendandtheoutflowendshallbelowerthanone-halfofthewaterdepth.III.Thedischargedwater’selectricconductivitymaynotfallbelowaneightypercentofthewastewater(pollutedwater)electricconductivityofthepreviousprocessingfacility.Withregardtotheprecedingparthree,thosewithhighelectricconductivityandlowelectricconductivitytwostreamsofthewastewater(pollutedwater)thatareprocessedseparatelybutdischargedjointly,andseparatesamplingpointsarealsoinstalledatvarioussamplingpoints’beforethevariousstreamsofthewastewater(pollutedwater)enteringintothejointdischargepipework,trenchordischargepoint,mayhavethedischargedwaterelectricconductivityatvarioussamplingpointsandthewastewater(pollutedwater)electricconductivityafterprocessedbythepreviousprocessingfacilityrenderedseparately. Article10-1Theterm“delusion”asreferredintheActdoesnotincludethemethodofseawaterfluegasdesulfurizationusedbycoal-firedpowerplantstoeliminatesulfuroxides. Article11Inordertoverifythefunctioningofanenterprise'swastewater,sewageandsludgetreatmentfacilitiecompetentauthoritiesatalllevelsshall,whenperforminginspectionworkpursuanttoArticle26,ParaSubparagraph1ofthisAct,notifytheenterprise14dayspriortotheinspectionto,onthedayofinspectionincreaseitsproductiontoconditionsofreportedoralreadyactuallyachievedroutinemaximumwaterpollutiooutputvolumesandtooperateitswastewater,sewageandsludgetreatmentfacilitiesinordertofacilitateinspection.Enterprisesthatareunabletocoordinatewiththeinspectionconditionsintheforegoingparagraphforsoreasonshallsubmittothecompetentauthorityanexplanationofthespecificreason,thedateonwhichitcaachievetheinspectionconditionsdesignatedintheforegoingparagraph,andrelevantverificationdocumentsthdayspriortotheoriginalinspectiondate.Anotherinspectiondateshallbesetafterthecompetentauthauthorization. Article12Thecompetentgovernmentauthoritiesofvariouslevelsconductingtheauditworkasstipulatedunderpar1,Article26oftheact,withinaspecificarea,mayappoint,assignorcommissionagovernmentagency(entity)orincorporatedentity,ororganizationtounderwritetheauditwork. Article13WhenacompetentauthorityatanyleveldispatchespersonnelbearingidentificationdocumentstoentepremisesofamilitaryauthorityinordertoperformverificationworkpursuanttoArticle26,Paragraph2ofthiAct,thepersonnelshallvisitrelevantpremisesorfacilitiestogetherwithlocalmilitarypoliceormilitaenvironmentalprotectionpersonnel.Theinspectedmilitaryauthorityshallprovidenecessaryassistancewhenundergoinginspectionorappraisalintheforegoingparagraph. Article13-1TransmissionorstorageequipmentasstatedinParagraphIofArticle28ofthislawshallrefertothefollowingequipment:I.Components,tanks,pumps,valve,pipelineandditchesforthecollection,storage,treatmentordischargeofwastewaterorsewage.II.Equipmentforthetransmissionorstorageofmaterials,intermediateitems,finishedproducts,by-products,petroleumproducts,chemicalagents,andwastes.LeakingasreferredtoinParagraphIofArticle28ofthislawincludesoverflowing,diffusionorleakage. Article13-2Othertypesofpollutantsasstatedinsubparagraph(II),ParagraphIofArticle30ofthislawarespecifiedbelow:I.Therawmaterialsrequiredfortheoperationprocessoftheindustry,andtheintermediateitems,products,by-products,scraps,anddumpsfromtheproductionprocess.II.Petroleumproducts,chemicalagentsormedicament,pesticide,chemicalfertilizers,seasonings,andcleansers.III.Sediments.IV.Kitchenwaste,animalremains,excreta.V.Othersubstancesannouncedbythecompetentauthority. Article14(Deleted) Article15ThecompetentgovernmentauthoritiesofvariouslevelsunderArticle36,inresponsetobusinessentitiesdeliberatelydischargingintothesoilorgroundsurfacewaterbodythewastewater(sewage)containingsubstancesharmfultothehumanbodyandexceedingvariouscontrolstandards,ordeliberatelyinjectingwastewater(sewage)containingsubstancesharmfultothehumanbodyintotheundergroundwaterbodytobesuspiciousofcriminalityshallreportandtipofftheincidenttotheprosecutor.Theterm“deliberately”asreferredintheprecedingparagraphreferstooneofthefollowingcircumstances,where:1.Thedirector,supervisoryplanneroractorhasconstitutedthefactsofcriminality,andwhoalsoknowinglyanddeliberatelyallowingittooccur;or2.Thedirector,supervisoryplanneroractorhasconstitutedthefactsofcriminality,andwhoareabletoforeseetheoccurrencebutnonehasalteredtheirintentions. Article16Theterm“injectingintotheundergroundwaterbody”asreferredinArticle36(2)oftheActreferstoutilizingwelldigging,injectionpipeworkorpressurizedfacilityandrelatedequipmenttoinjectthebusinesswastewater(sewage)intotheundergroundwaterbody.Enterprisesorsewagesystemsinjectingwatergeneratedfromremediationofpollutionofsoilandgroundwaterintotheundergroundwaterbodywiththeapproval,afterreview,bythecompetentauthorityofthemunicipalityorcounty(city)inaccordancewiththeSoilandGroundwaterPollutionRemediationActshallnotfallinthemeaningoftheterm“injectingintotheundergroundwaterbody”asreferredinArticles32(1)and36(2)oftheAct. Article17Thetermdischargingintothesoilasreferredtounderpar1,Article36oftheactreferstodischargingviapipe,trench,barrelcontainer,silotruckandothernon-pipeworkmeanstodischarge,permeatedistributethebusinesswastewater(pollutedwater)intothesoil,butprecludingoneofthefollowingcircumstances,where:I.Thefarmingindustryreutilizationoperationalmanagementsoapprovedbycompetentagriculturalauthoritiesinaccordancewiththefarmingbusinesswastereutilizationmanagementmeasures.II.Thelivestockindustry’sgasfluid,gascompostthecompetentagriculturalauthoritieshaveapprovedaspartofthefarmlandfertilizerutilizationplan.III.Thesoiltreatmentpermitsasreviewedandapprovedbycompetentgovernmentauthoritiesofthecentral-ruledmunicipalitiesandcounty(city)municipalitiespertheact.IV.Thewastewater(pollutedwater)hasbeendischargedtoanon-permeablefiltrationandrelatedsegregationfacilityanddoesnotcomeintocontactwiththesoildirectly.V.Thepipeworkorequipmentisdamagedormalfunctionedtoresultinthewastewater(pollutedwater)leakinganddischargingintothesoilinashorttimeandnotonaregularbasis. Article18Thetermdischargingintothegroundsurfacewaterbodyasreferredtounderpar1,Article36oftheactreferstooneofthefollowingcircumstances,where,I.Voluminousdischargeofpollutants,whichthecompetentgovernmentauthoritiesreckonittoseverelyunderminethewaterqualityofthenearbywaterbodies.II.Thewastewater(pollutedwater)(pre-)treatmentfacilityhasnotbeenfittedwithsufficientfunctionsandequipmentasstipulatedbelow:(I)Underthemaximumoutputorservicescale,theprocessedwastewater(pollutedwater)canallensurethattheprocessedwastewater(pollutedwater)complieswiththelawanditsrelevantstipulations.(II)Theprocessingproductionorservicefacilityisabletoprocessthewatervolumecapacityunderforeseeableanomalyoperations.III.Thebusinesswastewater(pollutedwater)treatmentfacilityencounteringmalfunctionbutthebusinesshasfailedtoreporttothecompetentgovernmentauthoritiesasstipulatedunderArticle59oftheact.IV.Businessesfailingtoabidebythecompetentgovernmentauthoritieshaveorderedofceasingtoact,ceasingtostore,worksuspension,businesssuspensionorbusinessclosureperstipulatedbytheact,butcontinuetodischargingthewastewater(pollutedwater). Article19Thetermthevariouscontrolstandardsasreferredtounderpar1,Article36oftheact,focusingondischargingintothegroundsurfacewaterbodycontrolstandards,referstothebusinessdischargedwaterstandards,oceandischargepipework’sdischargedwaterstandardsandthespecificindustries’applicabledischargedwaterstandards.Itprecludesthetapwater’swaterquality/watervolumeprotectionareas,drinkingwatersource/waterqualityprotectionareas,totalvolumecontrolareasandrelatedenvironments’waterbodiesuniqueinnatureorrequiringprotectionwithadditionalortighteneddischargedwaterstandards. Article20CompetentauthoritiesatalllevelsthatissuewrittennoticerequiringimprovementsorcorrectionstobemadewithinadesignatedtimeperiodpursuanttotheActshallproduceseparatedisciplinarycitations. Article21ThecompetentauthorityshallperformtheworkresumptioncheckingandevaluationworkinArticle63ofthisActinaccordancewiththefollowingmethods.I.Testingofanenterprise'swaterpollutioncontrolmeasuresorsludgetreatmentfacilitiesbasedontheacroutinemaximumwastewaterandsewageoutputvolumereportedbytheenterprisewhenresumingoperationsII.TestingofthefunctioningofwaterpollutioncontrolmeasuresorsludgetreatmentfacilitiesbasedontheactualroutinemaximumwastewaterandsewageoutputvolumeoftheenterpriseIII.Assesstheenterprise'sregularlyreportedwaterqualityandwatervolumedata,thewaterqualityandwavolumedataresultingfromtestsperformedbythecompetentauthority,andthedailyaveragelimits,waveragelimitsandmonthlyaveragelimitsforwaterqualityandwatervolumes,andcomparethisdatawiththecurrentfunctioningoftheenterprise'sfacilities.IV.Othermethodsrecognizedbythecompetentauthority Article22"Withinaone-yearperiod"referredtoinArticle73,par1,andsubparagraph3ofthisActmeansthe365dayspriortothedateofviolation. Article23Thepartialpenaltyasruledpertheactasreferredtounderpar1,article66-3oftheactreferstoatwenty-percentofthenetpenaltyamountreceivedfollowingthecompetentgovernmentauthoritiesrulestheoffencepertheact. Article24TheseRulesshalltakeeffectonthedateofpromulgation.
